Machine Ranger operates as a marketplace connecting buyers and sellers of heavy equipment. We are not a party to transactions between buyers and sellers. Users agree to:
While we make every effort to ensure listing accuracy, Machine Ranger does not warrant that listing descriptions, prices, or availability are error-free. All equipment is subject to prior sale. Buyers are encouraged to conduct independent inspections before completing any transaction.
Submitting an offer through Machine Ranger does not constitute a binding contract. All offers are subject to seller acceptance and final negotiation between buyer and seller. Machine Ranger facilitates introductions and does not guarantee transaction completion. Price estimates, tax savings calculations, and financing estimates are illustrative only and do not constitute financial advice.
Financing options displayed on Machine Ranger are provided for informational purposes only. Actual loan terms, interest rates, and approval are subject to lender requirements and the applicant's credit profile. Machine Ranger is not a lender and does not guarantee financing approval.
Machine Ranger shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform or any transactions conducted through it. Our total liability shall not exceed the fees paid to us in the preceding 12 months.
Sales require a deposit of 10% of the listed price (minimum $500), payable via credit card, wire transfer, or certified check. The deposit secures the Equipment and initiates the sale.
Upon deposit, an inspection of the Equipment will be arranged at or near Seller's location. The inspection is conducted by a certified technician or qualified mechanic at Buyer's expense. Buyer must notify Seller in writing during the Inspection Period to accept or reject the Equipment.
If Buyer rejects the Equipment during the Inspection Period, Seller refunds the deposit minus a $750 restocking fee to cover administrative, handling, and relisting costs. Rejection must be in writing and based on the inspection.
In cases of Buyer cancellation, delayed acceptance, non-payment, or dispute, Seller may deduct a handling and recovery fee of 13% of the purchase price to cover costs including repairs, freight, storage, and administrative efforts.
Accepted sales are final — no refunds unless required by applicable law.
Post-acceptance, Buyer pays the balance within 5 business days via wire transfer, certified check, or credit card (subject to a 3% surcharge on credit card payments). Late payments incur 1.5% monthly interest plus collection costs.
Title and risk pass to Buyer upon full payment and delivery to the carrier (FOB Seller's location). Seller provides a bill of sale. Buyer handles all applicable taxes unless providing resale or exemption documentation prior to shipment.
All Equipment is sold "as-is, where-is" with no warranties unless separately provided. Machine Ranger is not responsible for the accuracy of information provided by equipment owners in listings, including descriptions, images, or specifications.
Known defects over $5,000 impairing function will be disclosed prior to deposit. Hours are approximate — Seller is not liable for errors. Buyer ensures proper use, legal compliance, and operator training.
Buyer is responsible for freight arrangements unless agreed otherwise in writing. Delays from carriers or force majeure events are not Seller's liability.
Risk passes to Buyer at carrier handover (FOB Seller's location). Damage claims must be reported to Seller and carrier within 24 hours of delivery — late claims are Buyer's risk.
Pre-acceptance cancellation by Buyer forfeits the deposit. Post-acceptance cancellation is not permitted.
Non-payment within 5 business days post-acceptance allows Seller to cancel — deposit forfeited and damages may be pursued. If Equipment becomes unavailable through no fault of either party, Seller will refund the deposit with no further liability.
Buyer indemnifies Machine Ranger for all claims arising from use or resale of Equipment, except in cases of Seller's gross negligence.
Disputes are resolved through negotiation first, followed by arbitration in Austin, Texas (American Arbitration Association rules) if unresolved within 30 days. The prevailing party is entitled to reasonable attorney's fees.
These Terms are governed by Texas law. Venue is Travis County, Texas.
These Terms constitute the full agreement between the parties. Updates are effective upon posting at machineranger.com.
Equipment images may be used in Machine Ranger promotions. By providing equipment information, you grant Machine Ranger a non-exclusive, worldwide, perpetual license to use such information for promotion and advertising.
You may not reproduce or distribute any material from machineranger.com except for personal, non-commercial use related to purchasing equipment.
Listing Equipment with Machine Ranger creates no financial or contractual obligation until a signed sales contract is executed. No fees are charged unless the Equipment is sold.
Listings will not display equipment owners' names or addresses. All transactions occur through Machine Ranger or its designated agents.
Equipment owners warrant they have legal authority to sell the Equipment, free of liens or claims, and indemnify Machine Ranger against related losses.
